1. About LiKAR & Acceptance

LiKAR ("the Service", "we", "us") is a cloud-based point-of-sale, inventory, billing, and accounting platform for licensed liquor retailers and distributors in India.

By creating an account, setting up a shop, or otherwise using the Service, you ("you", "the User") confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Eligibility & Licensing Responsibility

You must be at least 21 years of age (or the applicable legal drinking/trading age in your State) and legally competent to enter into a contract.

You are solely responsible for holding and maintaining every licence, permit, and registration required to trade in alcoholic beverages in your State — including the relevant State Excise licence, GST registration, and any transport/import permits.

LiKAR is a software tool only. It does not grant, verify, or substitute for any government licence, and using it does not make any sale, stock movement, or transaction lawful on its own.

3. Legal & Regulatory Compliance

You are responsible for ensuring that your use of the Service — including pricing, Maximum Retail Price (MRP) adherence, excise duty, VAT/GST, permit numbers, and record-keeping — complies with the Excise Act, rules, and notifications of your State and all other applicable laws.

You must not use the Service to sell to minors, sell during "dry days" or prohibited hours, sell outside your licensed premises, or otherwise facilitate any sale prohibited by law.

Reports, invoices, barcodes, and figures generated by the Service are provided to assist your record-keeping; you remain responsible for verifying their accuracy before relying on them for any statutory filing or return.

4. Accounts & Contact Details

You must provide accurate and current information, including a valid mobile number, at registration and shop setup, and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use.

We may use the mobile number and email you provide to send service, security, billing, and account-related communications.

5. Your Data

You retain ownership of the business data you enter (sales, stock, purchases, customers, accounts). You grant us a limited licence to store and process it solely to operate and improve the Service for you.

Depending on the hosting option you choose, your data may reside in a database you supply and control, or in a LiKAR-managed database. You are responsible for the lawful collection and use of any personal data (e.g. customer details) you enter.

We apply reasonable technical measures to protect your data and take periodic backups, but you are responsible for maintaining your own records as required by law.

6. Subscription, Trial & Fees

The Service may be offered on a trial, subscription, or activation-key basis. Trial accounts may be subject to usage limits, and access may pause when a limit or term ends.

Fees, where applicable, are as communicated to you at sign-up or activation. Except where required by law, fees are non-refundable.

7. Acceptable Use

You may not misuse the Service, attempt to gain unauthorised access, disrupt its operation, reverse-engineer it, resell it without authorisation, or use it to store unlawful content or facilitate unlawful transactions.

You may not use the Service to falsify statutory records, evade duty or tax, or defeat any regulatory control.

8. Service Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Features may be added, changed, or removed, and maintenance or third-party outages may cause downtime.

Offline/queued features are provided for resilience; you are responsible for confirming that transactions have synced and for reconciling your records.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

To the maximum extent permitted by law, LiKAR shall not be liable for any indirect, incidental, or consequential loss, or for loss of profit, revenue, data, or goodwill — including any fine, penalty, licence action, or tax demand arising from your use of, or reliance on, the Service. Nothing limits liability that cannot be excluded by law.

10. Suspension & Termination

We may suspend or terminate access if you breach these Terms, or where required to comply with law or protect the Service or its users.

You may stop using the Service at any time. Provisions that by their nature should survive termination (including data ownership, compliance responsibility, and limitation of liability) will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by a new version, and continued use of the Service after an update constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of India, and the courts having jurisdiction in India shall have exclusive jurisdiction over any dispute arising out of or relating to the Service.
